NZ Idol 2: Nik fails to appear in Court

It would have been better if Nik was making the headlines for topping the charts but instead he's in trouble with the law.

NZ Idol finalist Nik Carlson has been nabbed red-handed flouting his hometown's inner-city booze-ban while chatting to fans.

Nicholas Carlos Carlson, 27 – runner-up in the last televised Idol series – was caught by police with a bourbon and cola in his hand in a liquor ban area about 2am on January 8.

Details of the infringement were revealed in Masterton District Court yesterday at a hearing that Carlson failed to attend.

Sergeant Peter Rix, who made the arrest, said the singer was holding a bottle as he stood on the street outside Masterton's Stellar bar and restaurant.

Masterton's central business district has a liquor ban, which was in force at the time.

The bar had just closed and Carlson was being mobbed by a group of young fans.

They were far from impressed by their idol being dealt with by police, though Carlson was well behaved at all times, Mr Rix said.

"He was surrounded by about half a dozen people, some of whom got verbally abusive to police, and were shouting, `You can't arrest Nik' among other obscenities."

"He, on the other hand, was extremely cooperative and was a nice guy to deal with.

"It was a pleasant change from most of our customers in that environment."

Mr Rix said that, though he recognised Carlson, it was important that police treated all people breaching the liquor ban equally, regardless of who they were.

Carlson was due to appear in court yesterday charged with breaching the liquor ban, but did not make an appearance.

It is understood he had no intention of appearing and was given clear direction as to what the process would be if he did not show up at court.

If an offence does not carry a jail sentence and the defendant fails to appear, no warrant for their arrest can be issued.

However, the alleged offence can be proven by the officer involved, who formally signs an affidavit.

Carlson was further remanded till March 6 for the affidavit to be presented to court and a conviction will be entered in his absence.

He will be sent a notice of the fine imposed, which can range from $50 to $100 for a first offence.

Carlson, who has returned to Auckland to continue his singing career, could not be contacted yesterday. -- Stuff.co.nz

Nah. Just send him off to Redemption Hill. Seriously though haven't the cops in Masterton anything else to do. A warning would have been much more appropriate instead the state is going to spend money bringing a prosecution for what appears to be an oversight on Nik's behalf.  Standing ouside on the street with alcohol in one's hand is illegal but sitting down at a table outside is not. Go figure.

Actually I'm surprised the police bothered to charge him. It's obvious the bar had just shut leaving Mr Carlson to finish his drink outside and as he wasn't disruptive or unruly it would've made sense to say "Can't do that mate" and gotten him to tip his drink. End of issue.

I guess the Masterton Police have quotas too.
